Website Terms of Use
These terms (“Terms”) govern your use of the focusing.app website (the “Website”), operated by Deeptegrity Kft., a limited liability company registered in Hungary, with its seat at 1117 Budapest, Baranyai utca 27, Hungary (“Deeptegrity”, “we”, “us”). By using the Website, you accept these Terms. If you do not accept them, do not use the Website.
These Terms do not govern The Focusing App. The desktop application is governed exclusively by its own Terms of Service and Privacy Policy, both presented in the application. The installer links on this Website point to our download host; downloading does not, by itself, grant you any license to the software. Your right to install and use the application arises solely under the application’s own Terms of Service, which apply to the application from download onward.
1. The Website Is Informational
The Website presents information about The Focusing App, including feature descriptions, example rulings, and pricing. This information is provided for general information only:
- We may change, correct, or remove any content on the Website at any time, without notice.
- While we aim for accuracy, we make no representation or warranty that the Website’s content is accurate, complete, or current, to the maximum extent permitted by law.
- Product capabilities, availability, and prices shown on the Website are informational. Purchases are made inside the application, and the binding terms for any purchase (including prices, renewal, cancellation, and your statutory consumer rights together with the conditions attached to them) are those presented in the application at the time of purchase. Nothing on the Website constitutes a binding offer.
- Nothing on the Website constitutes professional, legal, medical, or other advice.
2. The Interactive Demo
The Website may offer an interactive demo of the application’s interface. The demo is provided “as is”, for evaluation only. It may differ from the current release of the application, and we may modify, suspend, or remove it at any time without notice. No statement in or about the demo creates any warranty as to the application.
3. Pilot Requests
Submitting the pilot-request form is an inquiry, not a contract. Neither you nor Deeptegrity is under any obligation unless and until a separate agreement is concluded in writing. We may decline any request at our discretion. By submitting the form you confirm that the information you provide is accurate and that, where you act for an organization, you are authorized to make the inquiry on its behalf. Our processing of the submitted data is described in the Privacy Policy.
4. Acceptable Use
In connection with the Website, you agree not to:
- use the Website for any unlawful purpose;
- interfere with, overload, probe, or disrupt the Website or its infrastructure;
- circumvent, disable, or tamper with security or anti-abuse measures (including the bot protection on the pilot-request form);
- access the Website by automated means at a volume or frequency that burdens it, or harvest content or data from it at scale;
- submit false, misleading, or third-party personal information through any form;
- frame or mirror the Website, or misrepresent your affiliation with Deeptegrity.
5. Intellectual Property
The Website and all of its content (software, design, text, graphics, and branding, including “The Focusing App” name and marks) are owned by Deeptegrity or its licensors and are protected by intellectual property laws. You are granted a limited, revocable, non-exclusive right to access and view the Website for your own informational use. No other right or license is granted. Feedback you send us may be used by us without obligation to you.
6. Third-Party Services and Links
The Website relies on the third-party services described in the Privacy Policy (for example, content delivery for the demo’s rendering engine) and may link to third-party websites. Those services and websites are operated under their own terms and policies, for which we are not responsible.
7. Disclaimer of Warranties
The Website is provided “as is” and “as available”, free of charge. To the maximum extent permitted by law, we disclaim all warranties regarding the Website, express or implied, including availability, uninterrupted or error-free operation, and fitness for a particular purpose. This section does not limit any warranty or right you may have under the application’s own Terms of Service with respect to the application, or any right that cannot be disclaimed under applicable law.
8. Limitation of Liability
To the maximum extent permitted by law, Deeptegrity is not liable for damage arising out of or relating to your use of, or inability to use, the Website, including indirect or consequential losses, lost profits, or lost data.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including, under the Hungarian Civil Code, liability for intentionally caused damage or for damage to human life, physical integrity, or health, and any mandatory consumer rights. Liability in connection with the application itself is governed by the application’s own Terms of Service.
9. Changes to These Terms
We may update these Terms at any time. The version published on this page, with the date above, is the version in force; your use of the Website after a change constitutes acceptance of the changed Terms.
10. Governing Law and Disputes
These Terms are governed by the laws of Hungary, excluding its conflict-of-law rules.
If you are a consumer residing in the EU/EEA, you additionally benefit from any mandatory provisions of the law of your country of residence, including any mandatory rules on jurisdiction, and nothing in these Terms deprives you of those protections. For users who are not consumers, the courts of Hungary have exclusive jurisdiction.
Out-of-court dispute resolution: Consumers in Hungary may turn to the conciliation board (békéltető testület) competent for their place of residence; for Budapest this is the Budapesti Békéltető Testület.
11. Miscellaneous
If any provision of these Terms is found invalid, the rest remains in effect. These Terms are provided in English. Our imprint (legal disclosure) is published below on this page.
